THIS AGREEMENT DISCUSSES YOUR RIGHTS AND RESPONSIBILITIES AS A VISITOR OR SUBSCRIBER.  PLEASE READ THE TERMS OF USE AGREEMENT, THE PRIVACY POLICY AND THE EMAIL POLICY BEFORE USING THIS WEB SITE.

It is understood that A Jew and His Money (hereinafter referred to as ‘AJAHM’, ‘our’, or ‘we’) is an investment publishing company.  It is also understood that Users of the site (hereinafter referred to as ‘Users’, ‘Subscribers’, or ‘you’) operated by AJAHM are interested in, and seeking information relating to publicly traded securities in the U.S. and elsewhere.

By visiting AJAHM’s web site(s), Users agree to the Terms & Conditions outlined within our Terms of Use Agreement, Privacy Policy and Email Policy.  It is the User’s responsibility to read and understand these three AJAHM documents (Terms of Use Agreement, Privacy Policy, and Email Policy) prior to reviewing any information from AJAHM, signing up for any free or paid subscription newsletter service, or submitting any personal information to our firm.

Subscription Services

Certain articles of content provided by AJAHM require a paid subscription in order for users to have access to this information.  This includes but is not limited to A Jew and His Money and A Jew and His Gold newsletters.  Users who register for paid subscription services provided by AJAHM agree to

1. provide truthful and accurate information regarding their identity requested in user registration forms, and
2. update their user information on an ongoing basis in order to keep it accurate at all times.

Users understand that information provided by AJAHM is copyrighted material and as such will not be passed on to any third party without the prior written consent of AJAHM.

Free Trials

One free trial is offered to all eligible users for a 30 day period, after which a paid subscription will be required to access the site.  Those participating in the trial offer are not permitted to share access with any third party without the prior written consent of AJAHM.

Those who abuse the trial offer will be informed in writing that free access is available for a 30 day period but once.

Continued abuse of the trial offer will result in immediate blacklisting from the site, regardless of user’s membership status.

Payment and Subscription Renewal

Current subscription rates are listed by AJAHM in the membership area of the website. Individual subscription information (including renewal dates and fees) is listed in the account management section of the AJAHM website and provides users with a complete understanding of when they have been billed in the past, and when they will be billed in the future.

Subscriptions will automatically renew at the end of the initial subscription period, and users will be billed for the future billing period at the time of renewal unless otherwise specified.  Users agree to pay all fees and charges in connection with subscriptions to all paid AJAHM services, including any applicable taxes.  Users understand that subscription rates and fees are subject to change, and that notice of any such change will be posted prominently on the website or delivered by email to all subscribers.  A user’s failure to cancel a subscription could result in that user being billed according to the new billing plan once it goes into effect.

Cancellation Policy

Paid subscriptions can be terminated by the user either through the account management sections of the AJAHM website or by contacting us directly via the website.  Users are advised to retain any written confirmation in the event of a dispute arising from a cancellation.

Cancellation will take effect within ten business days of the date of the cancellation request. Subscribers agree not to dispute refunds with AJAHM or their personal credit card companies or banks.

Ownership of Materials

Except as otherwise indicated, the AJAHM website and its entire contents (collectively, the ‘Materials’), including but not limited to the text, information, material, software and graphics contained on the website are owned by AJAHM and its affiliates. The Materials are protected by copyright, trademark and other intellectual property laws and treaties.  AJAHM makes no proprietary claim to any third party names, trademarks or service marks appearing on its website. Any third party names, trademarks and service marks are the properties of their respective owners.  Except as provided in the next sentence, the Materials may not be copied, reproduced, modified, published, uploaded, downloaded, posted, transmitted, or distributed in any way, without AJAHM’s prior written permission.  You may download one (1) copy of the Materials on a single computer only for your personal, non-commercial, internal use.  You may not

• modify the Materials or use them for any commercial purpose or any other public display, performance, sale, or rental,
• decompile, reverse engineer, or disassemble software materials,
• remove any copyright notice or other proprietary notices from the Materials, or
• transfer the materials to another person.

Indemnification

Subscribers agrees to indemnify and hold AJAHM, its employees, its officers and its agents harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt and expenses (including but not limited to attorney’s fees) arising from a member’s use of this Web site or from a member’s violation of this Agreement or any third party’s rights including but not limited to copyright, property, and privacy rights.  This indemnification and hold harmless obligation will survive this Agreement and member’s use of this website.
